A former fire fighter was sentenced today in court to probation as he faced three counts of indecency with a child.
The District Attorney's Office says they were following the victim's wishes in this case.
Luis Rolando Garcia takes his walk towards Judge Oscar Hale, as he faces three counts of indecency with a child, charges stemming from more than 15 years ago.
Garcia was in the 406th District Court for sentencing.
He accepted a plea agreement for 10 years of probation with no jail time, something that the victim had requested from the district attorney's office.
Isidro "Chilo" Alaniz - District Attorney
" The victim came forward today and told the judge that this justice was his justice not the community's justice and I thought that was very important that he stated that."
The victim who is now an adult said in court this will bring him closure and he is glad everyone respected his decision to not send Garcia to prison.
Judge Oscar Hale - 406 District Court
" The court is honoring the recommendation made by the state."
According to the DA the most important thing is the accountability of Garcia’s actions.
And they are satisfied with the outcome in court.
" These cases have high incidents of a prison time attached to them. The state was also lucky though because there was really no evidence in this case. No medical evidence, no physical evidence, no DNA evidence." leaving the DA's office with just the victim's testimony to build a case against Garcia.
An important message for victims out there.
" Many times it takes many years to draw the courage to come forward to report abuse, sexual abuse. But there is no statue limitations."
Garcia has to register as a sex offender for the next 10 years.
He also has to give a one hundred dollar donation to the children's advocacy center.
Garcia will have to undergo a polygraph exam in the next 60 days and every year after that.
