District Attorney Reacts To Murder Conviction Reversal

A known zeta member will have a new trial due to a violation of the sixth amendment.
Our Lauren Kendrick talked to the district attorney and asked the hard question if the defendant deserves a second chance.
The sixth amendment means you have the right to a speedy and public trial.
District Attorney Isidro Alaniz tells us what he thinks of the reversal and their future plans for this case.
Webb County's District Attorney Isidro Alaniz, says of course they are disappointed with the reversal of the conviction, but he says those type of things happen in the legal system. He does say in this particular case, it is very rare.
"Judge Ender had stated because of fire code, there was no more room in the court and the court of appeals disagreed with that."
The jury selection in Garcia's case was closed to the public which his defense attorney says is a direct violation to the sixth amendment.
"Many people will call it a technicality, but it's a right that everyone has to have a public trial."
Alaniz says since the conviction was overturned for only one reason, they will not change much in the prosecution.
"We are very confident in the case we presented. The issue that was reversed was a decision made by the court. It was not a reversal based on evidence."
He adds that he respects that the defense team has to do their job, but he says there's a reason Garcia was sentenced to seventy years in prison.
"The people of Laredo like in many other communities across Texas and along the border are fed up with violent crime."
341 st District Judge, Becky Polomo, will be the judge presiding over this new case.
Alaniz says they have thirty days to seek a review by the entire court and in the event they do not go with that option, they'll prepare to try the new case.
We have obtained the poster where Joseph Allen Garcia appeared as the us marshal's top 15 most wanted.
In the poster it talks about how he was armed and dangerous, and he was wanted for murder, manslaughter and a list of other charges.
There used to be a reward for information leading to his arrest of $25,000.
He was arrested back in 2011 by us marshals in Matamoros, Mexico.
