Last night we brought you the story of a petition being filed to contest the results of the precinct one county commissioner race.
Incumbent Frank Sciaraffa filed late Friday afternoon alleging fraud and negligence against the election officials regarding the way the recount was done.
He also brought up the claim that Mike Montemayor does not live in the precinct.
We spoke to the current democratic chair who says once the petition was filed Montemayor has five days to respond.
Silverio Martinez says this matter should be cleared up pretty quickly:
"So we're looking at a pretty short fuse on this thing probably resolution in about I'd say 25 30 days at the latest."
He adds that the court will now decide how they want to handle this incident.
