Assistant Police Chief files lawsuit against city

He applied to be Chief of Police but he wasn't hired.
Now assistant police chief Fructoso San Miguel is fighting back against what he says is wrongdoing on the city's part.
San Miguel is now suing the city of Laredo and even filed a restraining order.
Attorneys claim this isn’t a case of a sore loser they say assistant police chief Fructoso San Miguel simply wants justice.
The battle is on as Fructoso San Miguel files a lawsuit against the city of Laredo to void their decision for chief of police.
Martinez claims the city never opened its doors to the public in the selection process for a new chief.
Violations he says will bring negative impact to residents of Laredo.
And talks of a restraining order have now been agreed to by the city.
For the next 23 days the city cannot demote or terminate San Miguel all stemming from threats he claims were made against him.
The concern of violations comes as San Miguel is turned down for chief of police.... Something attorneys say is not the reasoning behind the lawsuit.
“We're not here as a disgruntled employee trying to get his job ... that’s not what this case is about. This case is about opening the government to the public.”
A case the current chief says will not get in the way.
“Those other issues ...those are issues I don’t want to get involved in the organization. Let the legal battles begin or discussions take place outside. right now I want to focus the energy on something a little more productive.”
Ultimately the lawsuit asks that the city void its decision in the hiring of Carlos Maldonado and redo the entire process.
The next hearing is set to take place on July 23.
