Demond Bluntson is not expected back in court until later on this week.
Defense attorney Hugo Martinez says his staff is working on re-submitting their case on Monday.
A court administrator for Judge Lopez says the earliest he will hear the case is Friday.
You may recall we reported that Bluntson's defense attorney was trying to get his client out on bond, since he wasn't indicted within 90 days of being charged.
Bluntson remains in the Webb County Jail; he is charged with two counts of capital murder.
