LIVE at 5: Defense Speaks on Aggravated Assault Case

A sentencing hearing in a case dating back to 2009 begins Friday morning. Ruben Garza plead guilty to shooting a man in the jaw three years ago. Our cameras were there when the state presented witnesses in this hearing. Noraida Negron has the latest.
It's a case of shooting that happened on August 29th three years ago. The victim in this case was present during the hearing and took the stand Friday afternoon. At the time of the incident, he had life threatening injuries and has, since then, fully recovered. Prosecutors presented and showed the pictures of the injuries the victim received. When the victim took the stand he talked about what happened that night. He says he was in his apartment and heard a discussion downstairs, when he checked it out, he saw his roommate arguing with two other men, one of them, the accused, Ruben Garza. He also described how one had a gun and the other suspect had a beer bottle. That's when one pulled the victim aside and hit him with the bottle and the other one shot him.
Also, a doctor who treated the victim took the stand, and the investigator in this case. Ruben Garza is now facing charges of aggravated assault. If found guilty in this case, he could face 2-20 years in prison. However, prosecutors told Pro8News that they are looking for the maximum which is 15 - 20 years in prison.
