"The teacher is still teaching and I don't believe that she should be in there with other kids."
Two months ago Eduardo Elizondo claims his six-year-old autistic son was physically assaulted by a teacher at Malakoff Elementary School.
He says, he was promptly notified when the incident occurred but upon examining school hall surveillance video the teacher's report didn't match.
An investigation ensued and is still being processed which leaves Mr.Elizondo wondering why shes still employed.
"It's an insult not just for me but for the children that cannot speak for themselves especially for my son who is suffering, he was humiliated and physically abused by this teacher and is still allowed to teach here."
U-I-S-D assistant super intendant for human resources David Garcia says that quote,“in America a person is innocent until proven guilty.”
Which is why the school teacher is still being allowed to teach.
"whenever concerns are received they are investigated, the result of that investigation will determine if the district will take the appropriate action."
The district says, they can not make any drastic decisions without knowing all the facts.
"as much as a parent has rights to protect the child, we have to take care of that child as well, yet our employees have specific rights."
Mr.Elizondo says, he doesn't want what happened to his child to happen to another autistic child.
"justice and i want video cameras in those classes where those children are behind closed doors unknown to what is happening to them."
Mr.Elizondo says, he is getting together with a autism advocacy group to see if they can get cameras installed in schools.
